Posh Nosh Terms & Conditions

An order placed by a customer constitutes an offer to purchase goods or services. No contract shall exist until Posh Nosh has accepted the order by issuing an order confirmation or otherwise confirming acceptance in writing. Posh Nosh reserves the right to refuse any order at its discretion.

Whilst every effort will be made to supply the products ordered, Posh Nosh reserves the right to substitute ingredients or products where necessary due to availability. Any substitute will be of equal or higher quality and, where reasonably practicable, customers will be notified if the substitution affects allergens or dietary requirements. Product images displayed on our website are for illustrative purposes only, and products supplied may vary slightly in appearance.

Whilst every effort is made to ensure that prices are accurate, errors may occasionally occur.

Posh Nosh reserves the right to correct any pricing, typographical or administrative errors on our website, quotations, emails, order confirmations or invoices prior to the fulfilment of an order.

If a pricing error is identified after an order has been placed but before it has been fulfilled, we will notify the customer as soon as reasonably practicable. The customer will have the option to proceed with the order at the correct price or cancel the affected order without penalty.

Prices are subject to change without notice. However, any accepted and confirmed order will be charged at the agreed price, unless an obvious pricing error has occurred.

Promotional offers, discounts and special pricing may be withdrawn or amended at any time unless already applied to an accepted and confirmed order.

All prices quoted are exclusive of VAT unless otherwise stated.

We will make every effort to deliver on time. Delivery times are estimates and may be affected by traffic, weather or other circumstances outside our control. Customers are responsible for providing accurate delivery addresses, contact details, site access instructions and any relevant security or parking information. Where a delivery cannot be completed due to incorrect information or circumstances within the customer’s control, Posh Nosh reserves the right to charge the full order value together with any reasonable redelivery costs.

Risk in the goods passes to the customer upon delivery to the agreed delivery location or, where applicable, upon collection by the customer or their appointed representative.

It is the customer’s responsibility to ensure that the goods are stored, handled and consumed in accordance with any guidance provided by Posh Nosh following delivery.

Posh Nosh is committed to providing high-quality products and excellent customer service.

Requests for refunds or account credits must be reported within 24 hours of delivery and will be assessed on a case-by-case basis.

Refunds or account credits will only be issued following a full investigation by Posh Nosh into the circumstances of the claim. We may request supporting information, including photographs or other relevant evidence, to assist with our investigation.

Where a refund or credit is approved, it will be processed using the original payment method or applied as a credit to the customer’s account, as appropriate.

Payment is due in accordance with the agreed payment terms stated on the invoice.

Where payment is not received by the due date, Posh Nosh reserves the right to charge statutory interest and claim compensation for debt recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, as amended.

We also reserve the right to suspend or refuse further orders and deliveries until all outstanding balances have been paid in full.

The customer shall be responsible for any reasonable costs incurred by Posh Nosh in recovering overdue amounts.

Posh Nosh will use all reasonable care and skill in the preparation and delivery of its products and services.

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to the above, Posh Nosh’s total liability in connection with any order shall not exceed the value of the goods or services supplied.

Posh Nosh shall not be liable for any indirect or consequential loss, including loss of profit, loss of revenue, loss of business, loss of opportunity or business interruption arising from the supply of goods or services.

Posh Nosh shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to severe weather, flooding, fire, industrial action, power failure, supplier failure, vehicle breakdown, road closures or acts of government.

These Terms & Conditions, together with any documents expressly referred to within them, constitute the entire agreement between Posh Nosh and the customer and supersede all previous discussions, correspondence or agreements relating to the order.

If any part of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain valid and enforceable and continue in full force and effect.

Any failure or delay by Posh Nosh in exercising any right or remedy under these Terms & Conditions shall not constitute a waiver of that right or remedy, nor prevent its exercise at a later date.

Posh Nosh reserves the right to amend these Terms & Conditions from time to time. Any changes will apply to orders placed after the revised Terms & Conditions have been published on our website and will not affect orders already accepted unless otherwise agreed in writing.
